Terms of Service

1. Who These Terms Are With

These terms govern the services provided by OperateAI, operated by Ajay Singhadiya, a sole proprietor trading as OperateAI, based in Jaipur, Rajasthan, India ("OperateAI", "we", "us"). By engaging our services or using this website, you ("client", "you") agree to these terms.

2. Our Services

We provide AI automation audits, builds, and optional ongoing maintenance, as described on our website and confirmed in a written quote after a discovery call. The specific scope, deliverables, and price for your project are set out in that quote, which forms part of these terms.

3. Quotes and Pricing

Prices shown on the website are ranges. Your final, fixed price is confirmed in writing after the free discovery call. Third-party running costs (servers, AI API usage, WhatsApp Business API, and similar) are not included and are billed to you directly by those providers.

4. Payment Terms

  • Audit: paid up front. Credited toward a Build if you proceed within 30 days.
  • Build: 50% up front, 50% on go-live.
  • Maintenance (optional): billed monthly in advance.
  • Accepted methods: wire transfer, Razorpay, and Wise (for international clients).
  • International clients are billed in equivalent USD as quoted.

Refunds and cancellations are governed by our Refund & Cancellation Policy.

5. Your Responsibilities

You agree to give us accurate information, timely access to the systems and accounts we need, and prompt feedback. Delays caused by missing access or feedback may affect timelines and are not our responsibility.

6. Intellectual Property

Unless your quote says otherwise, on full payment you own the specific automation deliverables we build for you. We keep ownership of our pre-existing tools, templates, and know-how, and may reuse general skills and non-confidential learnings on other projects.

7. Third-Party Tools

Our builds connect to third-party platforms (for example n8n, OpenAI, Anthropic, WhatsApp, Google). We are not responsible for those platforms' availability, pricing changes, or their own terms. You are responsible for maintaining your own accounts with them.

8. Confidentiality

Each side agrees to keep the other's non-public information confidential and use it only for the project.

9. Limitation of Liability

We provide our services with reasonable skill and care. To the extent permitted by law, our total liability for any claim connected to a project is limited to the fees you paid us for that project. We are not liable for indirect or consequential losses, or for outcomes that depend on third-party platforms outside our control.

10. No Guaranteed Results

Automation outcomes depend on your data, processes, and third-party tools. We share realistic estimates based on past work, but we do not guarantee specific business results.

11. Governing Law and Disputes

These terms are governed by the laws of India. The courts at Jaipur, Rajasthan have jurisdiction. Before going to court, both sides agree to first try to resolve any dispute in good faith by discussion.

12. Changes to These Terms

We may update these terms. The version in force for your project is the one linked in your signed quote. For website use, the current version is the one posted here.
